Use of the Website

CESAR grants you a limited, non-exclusive, non-transferable, revocable license to access and use our website and digital services strictly in accordance with these Terms. All content published on CESAR's website and digital platforms — including but not limited to text, graphics, logos, icons, images, audio and video clips, course materials, research outputs, software, user interface designs, data compilations, and instructional methodologies — is the exclusive property of CESAR or its content licensors and is protected under Brazilian intellectual property law (Lei n.º 9.610/1998 — Lei de Direitos Autorais) and applicable international conventions, including the Berne Convention.

The CESAR name, logo, wordmark, and all associated brand elements are registered or common-law trademarks of Centro de Estudos e Sistemas Avançados do Recife. Nothing in these Terms shall be construed as granting any license to use CESAR's trademarks without prior written authorization.

You may not reproduce, duplicate, copy, sell, resell, distribute, publicly display, or otherwise exploit any portion of our content for commercial purposes without express written permission from CESAR. Limited quotation for academic, journalistic, or educational commentary purposes is permitted provided that clear attribution to CESAR is given and the use is consistent with fair-use principles under applicable law.

Any feedback, suggestions, ideas, or improvements you voluntarily submit to CESAR regarding our website or services may be used by us freely and without restriction or compensation to you. Submission of such material constitutes an irrevocable assignment of all associated intellectual property rights to CESAR.

  • Introducing, transmitting, or activating any virus, Trojan horse, worm, logic bomb, spyware, adware, ransomware, or other malicious or technologically harmful material.
  • Circumventing, disabling, or otherwise interfering with security-related features of the website, including any features that prevent or restrict the copying of content or enforce access limitations.
  • Using the website to send unsolicited commercial communications (spam), chain letters, pyramid schemes, or any other unauthorized advertising or promotional material.
  • Collecting or harvesting personal data of other users without their express consent, or using such data for any purpose not authorized by these Terms.

CESAR reserves the right to investigate suspected violations of these conduct rules. If we determine that a violation has occurred, we may take any appropriate action, including issuing warnings, suspending or terminating access, and referring matters to law enforcement authorities.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, CESAR provides this website and all its contents, features, and services on an "as is" and "as available" basis, without representations or warranties of any kind, whether express, implied, or statutory. CESAR specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of a course of dealing, performance, usage, or trade practice.

CESAR does not warrant that the website will function without interruption, that it will be free from errors, viruses, or other harmful components, or that any defects will be corrected. Where CESAR's liability cannot be entirely excluded under applicable Brazilian consumer protection law (Lei n.º 8.078/1990 — Código de Defesa do Consumidor), our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount you paid to CESAR, if any, in the twelve (12) months immediately preceding the event giving rise to the claim, or BRL 500.00, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless CESAR, its parent organizations, subsidiaries, affiliated research institutes, corporate partners, officers, directors, employees, faculty members, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses — including reasonable attorneys' fees — arising out of or relating to:

  1. Your access to or use of our website or services in violation of these Terms.
  2. Your violation of any applicable law, regulation, or third-party right, including any intellectual property rights or privacy rights.
  3. Any content you submit, post, upload, or transmit through our platforms, including any claim that such content infringes or misappropriates the rights of a third party.
  4. Your negligent or willful misconduct in connection with your use of our services.
  5. Any misrepresentation made by you in connection with your registration or use of CESAR's platforms.

CESAR reserves the right, at its own expense, to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate fully with CESAR's defense of such claim. This indemnification obligation survives the termination or expiration of these Terms and your use of the website.

Governing Law

These Terms of Use shall be governed by, construed, and enforced exclusively in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict-of-law principles or rules that would cause the laws of any other jurisdiction to apply.

Any dispute, controversy, or claim arising out of or in relation to these Terms — including questions regarding their existence, validity, breach, or termination — shall be submitted to the exclusive jurisdiction of the courts of the Judicial District of Recife, State of Pernambuco, Brazil. Both parties expressly waive any objection to the venue of proceedings in those courts on the grounds of inconvenient forum or otherwise.

Notwithstanding the foregoing, CESAR retains the right to seek injunctive or other equitable relief in any competent court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or confidential information. Users who are consumers domiciled in Brazil retain all rights afforded to them under the Brazilian Consumer Defense Code (Lei n.º 8.078/1990) and Lei Geral de Proteção de Dados (Lei n.º 13.709/2018), none of which are diminished by these Terms.

Changes to These Terms

CESAR reserves the right to revise, amend, update, or replace any part of these Terms of Use at any time and at our sole discretion. When we make material changes, we will update the "Last updated" date displayed at the top of this page. In the event of changes that significantly affect your rights or obligations, we will take reasonable steps to notify you — for example, by displaying a prominent notice on our website, sending an email to your registered address, or posting an announcement in your user account dashboard.

It is your responsibility to review these Terms periodically to stay informed of any updates. Changes become effective immediately upon publication, unless we specify a different effective date. Your continued use of the website or any of our services after the posting of revised Terms constitutes your acknowledgment of, and agreement to be bound by, the modified Terms.
